The Advantage Gold lawsuit people search for turns out to be two short federal cases, both dismissed without any finding against the company. Advantage Gold complaints on the Better Business Bureau stood at zero for the past three years when we checked on October 5, 2026, against an A+ rating. The bigger story of 2026 is a data breach, not a lawsuit. This page lays out each record with its date and source, separates what was alleged from what was decided, and flags the contract terms worth reading before you sign.

Yes, Advantage Gold is a legitimate precious metals dealer. The public record shows no fraud finding, no regulator action and no judgment against it.
Advantage Gold LLC has held BBB accreditation since August 2014 and carries an A+ grade. The two federal lawsuits naming it, a 2022 telemarketing class action in Illinois and a 2025 case in California, both ended in dismissals filed by the plaintiffs or by agreement, with no court ruling on the merits. Searches of CFTC, SEC and state securities regulator material returned nothing naming the dealer.
Three things deserve your attention anyway: a network intrusion discovered in September 2025 that exposed personal data of roughly 7,960 people, purchase terms that make every sale final and send disputes to private arbitration, and a cancellation clause on the company's own terms page that, when we read it, still contained an unfilled placeholder where the fee should be.
Before reading any complaint file, pin down which business it belongs to, because "Advantage Gold" is a phrase several unrelated companies use. The precious metals dealer is Advantage Gold LLC. In a 2022 federal filing it described itself as a subsidiary of Advantage Group Holdings, LLC, with no publicly held corporation owning 5 percent or more, and in its answer to the same lawsuit it admitted being an Illinois limited liability company. Its BBB file records a business start date of June 5, 2014.
The address has moved. Older coverage, including earlier versions of our own review, described the firm as Los Angeles based. Today the BBB profile and the company homepage both list 3600 W Parmer Lane, Suite 107, Austin, Texas, while the terms and conditions page gives a second Austin address on Burnet Road for legal notices. Two addresses on one website is untidy rather than alarming, but if you ever need to send a written notice, such as the arbitration opt-out described below, use the one the terms page specifies.
The people are named. The BBB profile lists Kirill Zagalsky as managing director and Chelsey Jenkins as operations director, and the company's About page describes Zagalsky as chief executive and a co-founder in 2014. The homepage carries a plain statement that the firm and its representatives are not licensed or registered investment advisers. That disclaimer is accurate and useful: you are dealing with a metals retailer, so anything a representative says about where markets are heading is sales conversation rather than regulated advice.

We searched the federal docket index by case name on October 5, 2026. It returned two matters against the dealer. A third cluster of hits, cases captioned against "Century 21 Advantage Gold", concerns a real estate brokerage in foreclosure and bankruptcy disputes from 2007 and 2010, and has nothing to do with precious metals. Leave those out of any judgment you make.
This is the case most "Advantage Gold lawsuit" pages are half-remembering. It was filed on July 28, 2022 in the U.S. District Court for the Northern District of Illinois, No. 1:22-cv-03940, as a proposed class action under the Telephone Consumer Protection Act. The amended complaint alleged that Advantage Gold placed repeated unsolicited telemarketing calls to numbers on the National Do Not Call Registry, and the plaintiff listed calls he said he received in August and September 2021.
The company's answer, filed December 1, 2022, admitted only that it had placed telemarketing calls to the plaintiff and denied that it broke the law. On February 23, 2023 the court dismissed the action on a joint stipulation: with prejudice for the named plaintiff, without prejudice for everyone else. No class was ever certified, no court ruled on whether the calls were unlawful, and any payment to the plaintiff, if there was one, is not on the public docket.
Filed on October 28, 2025 in the Eastern District of California, No. 2:25-cv-03140, with an amended complaint in November 2025. The plaintiff filed a notice of voluntary dismissal on April 20, 2026 and the case was terminated the next day. The complaint is not publicly available in the index we used, so we cannot tell you what it alleged, and we will not guess. It was filed five months before the data breach letters went out, so there is no basis for assuming it concerns the breach.
After the breach notifications in March 2026, several plaintiff law firms published notices saying they were investigating and inviting affected people to get in touch. An investigation notice is advertising for claimants. As of October 5, 2026 our docket search showed no federal lawsuit filed against Advantage Gold over the breach. That could change, and a state court filing would not appear in the index we searched, so check before relying on this.
| CASE | COURT, FILED | CLAIM | HOW IT ENDED |
|---|---|---|---|
| Daschbach v. Advantage Gold, LLC, 1:22-cv-03940 | N.D. Illinois, July 28, 2022 | Telemarketing calls to Do Not Call numbers (TCPA), proposed class | Joint stipulation of dismissal, February 23, 2023. No class certified, no finding |
| Soto v. Advantage Gold LLC, 2:25-cv-03140 | E.D. California, October 28, 2025 | Not publicly available | Voluntary dismissal by plaintiff, April 20, 2026 |

On October 5, 2026 we searched for Advantage Gold in SEC EDGAR full-text filings, CFTC enforcement material, California DFPI actions and the most recent page of Texas State Securities Board administrative orders, which matters now that the company is based in Austin. Nothing named the precious metals dealer. Two near-misses are worth naming so they do not trip you up: the CFTC has issued orders against Advantage Futures LLC, a Chicago futures broker, and SEC filings mention an annuity product called the United Investors Advantage Gold Variable Account. Neither is this company.
We report that as the result of a search, not a clearance. The Texas board publishes its orders across several pages and we reviewed the latest one, covering April to August 2026, so an older Texas order would not have shown up in that check.
The Advantage Gold BBB profile showed an A+ rating, accreditation since August 8, 2014, zero complaints closed in the last three years and 10 customer reviews when we loaded it on October 5, 2026 (verified Oct 2026). Our own review had previously described the file as holding fewer than ten complaints; the current count is none.
Zero is a good number, and it also deserves a careful reading. The profile is the Austin record, and the company's earlier Los Angeles listing no longer resolves on the BBB site, so complaint history tied to the old address is not visible to a casual reader. Ten reviews is a thin sample for a firm that says it has handled over $1 billion in sales. Put together, the BBB file tells you that nobody has escalated a formal complaint there in three years. It does not tell you much about the average customer experience, which is where the review platforms come in.
Trustpilot carries the larger sample. On October 5, 2026 the Advantage Gold Trustpilot profile showed a TrustScore of 4.8 from 1,920 reviews, with 97 percent at five stars, on a claimed profile with a paid subscription. Trustpilot reported that the company replied to 80 percent of negative reviews, usually within two weeks.
The negative tail is small but specific. A one-star review dated September 17, 2026 describes a steep fall in account value within months and calls the commission high, criticising marketing that presented metals as safe. A June 10, 2026 review describes repeated failed attempts to reach a representative by phone. A December 2025 review disputes the value of the reviewer's holdings. These are individual customers' accounts, not findings, but they point at the two pressure points every dealer in this market shares: the premium paid on day one, which a falling metal price exposes quickly, and access to a person when you want to sell.
The first of those is the one to plan for. Metals can drop, and a portfolio bought at a large premium over spot starts the race behind. Our guide to gold IRA markups shows how to put a number on that premium before you buy, and the company's own homepage says plainly that metals carry a risk of loss and are not suitable for everyone.
Advantage Gold discovered unauthorized access to its network on September 5, 2025, traced to a flaw in third-party firewall software, and began notifying approximately 7,960 people on March 27, 2026. The exposed information included names, contact details, a limited number of Social Security numbers and custodian account numbers, and the company offered identity protection through Experian. Breach reports were filed with several state attorneys general, including Maine. This is an incident the company suffered rather than conduct toward customers, and our full Advantage Gold review covers the timeline and what affected readers should do. The legitimate criticism is the gap of almost seven months between discovery and notice.

Complaint counts describe the past. The contract describes what happens to you if something goes wrong in the future, so we read the Advantage Gold terms and conditions on October 5, 2026. Four clauses matter.
None of these terms is unusual in the metals trade, and several competitors use similar language. They do change how you should read a clean court record, and they make the written quote, with the premium over spot and the buyback price on the same products, the most important document in the transaction. Our list of questions to ask a gold IRA company covers what that quote should contain, and the Advantage Gold fees breakdown covers the account charges themselves.
| WARNING SIGN | WHAT WE FOUND |
|---|---|
| Dealer holds your IRA metal itself or suggests home storage | Not found. The company uses third-party custodians and outside depositories, per its own FAQ and our review |
| Unnamed principals or no fixed address | Not found. Named managers on the BBB file and a published Austin address, though the site lists two |
| Regulator orders or fraud findings | None found in CFTC, SEC, DFPI or recent Texas SSB material, October 2026 |
| Unsolicited calling | Alleged in the 2022 Illinois case, which was dismissed without a finding. Record any call you did not request |
| Premium over spot not disclosed in writing | Markups are acknowledged in the risk disclosure but not quantified. Ask for the percentage on every item |
| Pressure to decide on the call | Not something a document can show. Treat any same-day deadline as a reason to pause |

On the record, the case for Advantage Gold is a decade-long operating history, a strong Trustpilot sample, no regulator action and an untroubled BBB file. The case against is the 2025 breach and its slow notification, terms that send disputes to arbitration, and pricing that is quoted on the phone rather than published. If you want to see how it stacks up against a firm with a longer buyback record, read Goldco against Advantage Gold; if a lower entry point matters more, Orion Metal Exchange compared with Advantage Gold is the closer match. Every provider we cover is scored on the same method on the gold IRA company reviews page.
Yes. Advantage Gold LLC is a real precious metals dealer that started in June 2014, has been BBB accredited since August 8, 2014 and held an A+ rating with zero complaints closed in the past three years when we checked on October 5, 2026. We found no CFTC, SEC or state securities regulator action naming it, and the two federal lawsuits against it were both dismissed without any finding. It uses third-party custodians and outside depositories for IRA metal. The cautions are a 2025 data breach, sales terms that make every order final, and disputes routed to private arbitration.
There have been two federal cases, and both are closed. Daschbach v. Advantage Gold, LLC, No. 1:22-cv-03940 in the Northern District of Illinois, was a proposed class action alleging telemarketing calls to numbers on the Do Not Call Registry; it was dismissed on a joint stipulation on February 23, 2023, before any class was certified and without a ruling on the merits. Soto v. Advantage Gold LLC, No. 2:25-cv-03140 in the Eastern District of California, was filed in October 2025 and voluntarily dismissed by the plaintiff on April 20, 2026; its complaint is not publicly available. As of October 5, 2026 we found no federal lawsuit over the 2025 data breach.
No. Nothing in the court, regulator or BBB records we reviewed in October 2026 describes deception of customers, missing metal or misuse of IRA funds. The company has named managers, a fixed Austin address, a decade of BBB accreditation and the standard custodian and depository structure. Customer complaints that do exist, mostly on Trustpilot, concern losses after metal prices fell, commissions, and difficulty reaching a representative, which are reasons to get pricing in writing rather than evidence of a scam.
A+. The Better Business Bureau profile for Advantage Gold LLC in Austin, Texas showed an A+ rating, accreditation since August 8, 2014, a business start date of June 5, 2014, zero complaints closed in the last three years and 10 customer reviews on October 5, 2026. The company's older Los Angeles BBB listing no longer loads, so complaint history tied to that address is not visible on the current profile.
With no BBB complaints in the three years to October 2026, the visible complaints are on Trustpilot, where the profile showed 4.8 from 1,920 reviews. The small number of one-star reviews describe account values falling after purchase, commissions the reviewer felt were high, and trouble reaching a representative by phone. Trustpilot reported the company replied to 80 percent of negative reviews. These are individual customer accounts, not findings.
Yes. The company discovered unauthorized access to its network on September 5, 2025, attributed to a flaw in third-party firewall software, and began notifying about 7,960 people on March 27, 2026. Names, contact details, a limited number of Social Security numbers and custodian account numbers were among the data exposed, and affected people were offered Experian identity protection. Breach reports were filed with state attorneys general including Maine.
Usually not in court. The company's terms and conditions, read on October 5, 2026, require disputes to go to individual binding arbitration under American Arbitration Association consumer rules, with jury trials and class actions waived, under Texas law. The terms allow customers to opt out of arbitration within 30 days by mailed notice to the company's legal address. Sales are final, and cancelling a confirmed order makes you liable for market loss plus a fee whose amount the terms page left as an unfilled placeholder.
